The Legend of Hanzo and The Legend of Hanzo: Arena are Projects of Forge Universe Blacksmith Labs Ltd.



The Legend of Hanzo NFTs are different Collection, now and in the future, randomly generated 2D or 3D Grafics and deployed on the ETH network. The Legend of Hanzo MMORPG is an online game to which buyers of the The Legend of Hanzo NFTs will get Items, Cosmetics or other Benefits for in game use when the game is finished.

The game's are still in development, therefore not yet released, and this may result in changes to the different Skins, capabilities, and usage. Smart contracts grant the right to the specific skin and item purchased and only that. The game is still under development, therefore characters, elements, features can change things such as visuals etc.

 

DEFINITIONS

NFT: means non-fungible token which can be bought on Polygon Network using cryptocurrency.

Game, Game's, Mobile Game or MMORPG: means the by Forge Universe Blacksmith Labs Ltd. distributed applications, where individual persons can play together earn ingame loot and items, buy Items and skins, which then can be traded in game and can be use outside the game as avatars.

Site: means the http://thelegendofhanzo.com website that the player of the Game's or buyer of The Legend of Hanzo NFTs can interact with.

Skins/Items: means the collection of items and anything related thereto in The Legend of Hanzo Arena and MMORPG game built upon The Legend of Hanzo NFTs which individual persons can buy from the Forge Universe Blacksmith Ltd. Team through the ETH Network.

Smart Contract: means the contract you automatically agree to on the Polygon blockchain to execute transactions.

 

TERMS OF USE

​

Non-fungible tokens are not an investment. All The Legend of Hanzo NFTs are just collectibles on the ETH network and should be treated as such. Game development is determined by user interest, adoption, and social adoption. You, the owner, agree that you purchase of this NFT collection is just as a collectible. You understand that they have no inherent monetary value, and they should be treated as nothing more than a collectible. The Legend of Hanzo makes absolutely no promises or guarantees regarding the value of The Legend of Hanzo NFTs aside from the one that we will strive to do the best for the project and the community.

By minting The Legend of Hanzo NFTs from our website or the smart contract; you acknowledge that you have read and do hereby accept the terms and conditions listed above.

Terms of use may be updated without notice at any moment; however, all changes will be updated on our Website, Discord and Telegram for convenience and ease. As the project advances the terms may be subject to modification at any moment.

You agree to any ongoing changes to our policy (excluding NFT ownership and proprietary use) as a participant of The Legend of Hanzo NFTs mint, private sale, after market, and giveaways.

 

IP RIGHTS & Ownership

​

The name and Intellectual Property involved in The Legend of Hanzo Arena and MMORPG Project (“The Legend of Hanzo”) is owned by Forge Universe Blacksmith Labs Ltd. (The Team) All rights that are not specifically granted to the users and owners of The Legend of Hanzo NFTs below are reserved by the team. This includes but is not limited to the intellectual property rights surrounding the “The Legend of Hanzo Game” and “The Legend of Hanzo MMORPG” names, logos, 3d layer files, trademarks, the website, the look and feel of the user interface, the smart contract code, or anything else not specifically granted by any following licenses.

By holding a The Legend of Hanzo NFTs in your crypto wallet, you gain full and complete ownership of your NFT as well as the opportunity to utilize this NFT in minting or receiving subsequent opportunities available only to The Legend of Hanzo NFTs holders.

All NFTs ownership is verified cryptographically on the ETH Blockchain. This is proof of ownership and grants rights within this document. Once the NFT leaves ownership, all Personal and Commercial use terms are revoked.

   Subject to compliance with these terms, Forge Universe Blacksmith Labs Ltd. grants you a royalty-free license to use, copy, display, and modify The Legend of Hanzo NFTs that you own for The Legend of Hanzo NFTs Art. This usage is granted world-wide.

      This usage is for the limited purposes of:

 

1. Personal and Non-Commercial Use

2. Display and usage of your NFT on External Websites

3. Ability to Buy, Sell, and Trade your NFT

1. Commercial and Derivative Rights

 

When it comes to limiting commercial rights, we want you as an NFT holder to realize that you must use The Legend of Hanzo NFTs in its entirety.

 

Use of the The Legend of Hanzo NFTs Licensed Materials must be in full and in their entirety. Licensed use of The Legend of Hanzo NFTs must include the complete Rig/Image/Model and rights are reserved for all underlying image files including layered filed for individual proprietary The Legend of Hanzo NFTs traits. These rights are reserved for the Forge Universe Blacksmith Labs Ltd. and are expressly prohibited to be used outside of the full Rig/Image/Model. These individual layered files are proprietary and of HANZOs own creation.

 

The Legend of Hanzo expressly prohibits the use of any proprietary, individual traits or crafted layers in all other projects. The Legend of Hanzo also prohibits the sale or promotion of counterfeit NFTs or NFT collections. Counterfeit NFTs or collections contain art that is identical to or substantially indistinguishable from the original The Legend of Hanzo NFTs, including:

 

NFTs described as knock off, replica, imitation, clone, faux, fake, mirror image, or similar terms when referring to an NFT or NFT Collection in an attempt to pass themselves off as genuine The Legend of Hanzo creations.

Non-genuine products that mimic The Legend of Hanzo NFTs features or proprietary traits in an attempt to pass themselves off as genuine The Legend of Hanzo creations.

 

Otherwise, you are free to use your The Legend of Hanzo NFTs in the fullest sense of commercial and derivative use cases.

 

However, user shall not use any The Legend of Hanzo Licensed Materials in any way, or in connection with any material, which is unlawful, fraudulent, libelous, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, offensive or otherwise objectionable or unreasonable or infringing upon any laws or regulations or intellectual property rights or proprietary rights or confidentiality obligations and you shall indemnify and defend The Legend of Hanzo against any claims, damages, proceedings, loss or costs arising from such use. User shall not use the The Legend of Hanzo Licensed Materials in any way that could be construed as being adverse or derogatory to the image of The Legend of Hanzo or any of its subjects.

 

Taxes

You are entirely and solely responsible for any tax liability which may arise from minting, selling or owning your The Legend of Hanzo NFTs.
 

Children

​

The Legend of Hanzo project is not targeted towards children. You agree that you are over the age of 18, or above the legal age of your jurisdiction, whichever is greater.
 

Disclaimer & Warranties

​

Forge Universe Blacksmith Labs Ltd. to the fullest extent permissible under applicable law, makes no warranties of any kind related to the Site, the Game, and the Smart Contracts, whether express or implied. This also applies for any communication between us and you after your purchase of The Legend of Hanzo NFT’s.

The Site, Game and Smart Contracts are provided "as is" and "as available" and you understand and agree that the The Legend of Hanzo Game is still in production and the Website, App, these Terms and the The Legend of Hanzo NFTs purchased, and the resulting Skins and Skills may be subject to further development and change.

Forge Universe Blacksmith Labs Ltd. will not be held accountable, responsible or liable for any losses or damages, whether direct or indirect, you incur as a results of your use of Smart Contracts and the Polygon Network, and any payments and transactional actions performed by you in relation thereto.

The Legend of Hanzo NFTs are intangible digital assets that exist only by virtue of the ownership record maintained in the Polygon Network. You agree and understand that The Legend of Hanzo has no control over or and makes no warranties with respects to Smart Contracts, or losses due to blockchain or any other features of the Polygon Network.
 

 

Limitation of liability

Forge Universe Blacksmith Labs Ltd. cannot be held liable for any indirect, special, or incidental damages, such as but not limited to loss of data, loss of goodwill or business reputation, loss of profits (whether incurred directly or indirectly), or any other intangible loss you may incur, and you agree even if it has been advised of the possibility of such damages. You agree and understand that the total, aggregated liability to you for any claim arising out of or relating to these Terms, or your use of or access to the Site, the App and the Smart Contracts will be limited to 30% of the total amount you paid to us in a period of 6 months prior to the date the claim arose.

 

Indemnification

You agree to hold harmless and indemnify Forge Universe Blacksmith Labs Ltd. and its subsidiaries, affiliates, offers, agencies, advertisers, licensors, suppliers or partners against any claim, loss, liability, damage, of any kind or nature, suit, judgment, litigation cost, and attorneys’ fees arising from or in any way related to your breach of these Terms, misuse of the Site and the App, violation of Applicable laws, rules or regulations in connection with your access to or use of the Site and the App.
 

Privacy

When purchasing The Legend of Hanzo NFTs and using the Site and Game, we process your personal information. We are committed to protect your personal information from any unauthorized use, access, and disclosure.

 

Governing law and dispute resolution

These Terms and any dispute relation hereto, or to the use of the Site, the App, and the Smart Contracts, will be governed by and construed in accordance with the law of the United Kingdoms. In the event of any lawsuit or proceeding, the Courts of UK will have exclusive jurisdiction.

If a dispute arises relating to these Terms, both parties agree to first attempt to resolve the dispute by informal negotiations. If informal negotiations do not result in a satisfying resolution, you agree and understand that the dispute will be finally and exclusively resolved by binding arbitration in accordance with the law of the United Kingdoms.

 

Termination

These Terms shall remain effective and in full force while you use the Site, the Game, and the Smart Contracts.

​

Termination may only be effectuated by you if you cancel your account and cease to use the Site, and the Game.

​

Termination or suspension, depending on the cause, may be effectuated by us for any breach of these Terms, misuse of the Site, the Game, or the Smart Contracts, without warning, in our sole discretion. Termination or suspension may also be effectuated by us for any other action performed by you justifying such termination or suspension, including but not limited to, for example, all at our sole discretion:

1. Your application of the Site, the game or the Smart Contract for criminal purposes or fraudulent conduct;

2. Your application of the Site, the game or the Smart Contract with the intention to establish other financial instruments or engage in other financial transactions than already enabled on the Polygon Network and governed by the Smart Contract;

3. Requirement by applicable law, rule or regulation;

4. Termination or change of terms by third party service provider in relation to services necessary for us fulfill our obligations;

5. Risk of continued services creating a substantial economic burden on us;

6. Risk of continued services creating a security risk or material technical burden.

 

Upon termination your account will be deleted, and your access to the Site and the Game will expire and any rights granted in these Terms will expire.

 

Miscellaneous

You understand and agree that these Terms, the Site and Game may be subject to changes. You understand that the The Legend of Hanzo Game has not yet been released and more obligations and rights may be imposed on or granted to you in the future. It remains your own responsibility to keep yourself updated with changes to these Terms.
